REFLECTIONS ON LIFE U.S. SUPREME COURT CANNOT REDEFINE MARRIAGE No one is entitled to dismiss, neglect, ignore, let alone detest homosexuals, bisexuals or transsexuals of any kind. Any discussion about them does not give anyone a license to practice or even contemplate homophobia because of any gay appearance, condition or lifestyle. Based upon their rights by birth and by the commands of Jesus, we must love people of all orientations as Jesus loves us. With those disclaimers, we reluctantly undertake a dispassionate discussion of legalized same-sex marriage, since the U.S. bishops have written a pastoral letter on the subject and since the discussion would have to take place sooner or later. June 26, 2015 witnessed the U.S. Supreme Court rendering a ruling that there is a federal constitutional right to same-sex marriage. In order to rule thus on the institution of marriage, the court would have to change the millennia-old definition of marriage that has always included exclusively the union of a man and a woman. In its 5-4 ruling, it was crudely clear that the five majority justices exceeded their job description of ruling on the U.S. Constitution. Such a ruling cannot, must not include judicial activism that promotes an ideology or creates a law. This is not the first U.S. Supreme Court that is activist – that is, law -making – in some rulings. Though ignored in the final vote, the issue of judicial activism came into focus in the confirmation hearings on Sonia
Sotomayor in July, 2009. Forgetting the need to be always impartial, Sotomayor had made the legal blunder of touting being “a wise Latina” as a plus in making judicial decisions in minority cases. This should have disqualified her for any court at any level. A wise Anglo or other ethnic will do. Sotomayor is not alone in voting her ideology and feelings – the same issues that came up clearly in hearings on her confirmation. So much for the laughable notion of impartial judges who vote for the law solely on its own inherent merits! The feckless justices should have weighed the words of G.K. Chesterton in The Superstition of Divorce, “This triangle of truisms, of father, mother and child, cannot be destroyed; it can only destroy those civilizations which disregard it.” What is the actual issue driving homosexual lovers to desire the right to enter a samesex marriage? The issue is not the legal rights that a couple has from being yoked in a legal union, for those legal rights are the same whether the couple is heterosexual or homosexual. What homosexual couples desire is the dignity, the status and respect that accrue to the union of a couple with the sanction of marriage. No one can blame them for wanting those blessings of marriage. However, the basic problem remains of the immutable nature of the institution of matrimony that ceases to be matrimony when folks change its substantive components. And there is nothing more substantive than opposite-sex and same-sex partners, since nature provides female and male sexual plumbing and linkage in us
humans. Thus, attempting to redefine the nature of marriage does not achieve a new reality, and so it does not fulfill the Supreme Court’s activist purpose to right wrongs against gays. The impotent attempt of the U.S. Supreme Court to redefine something over which they have no jurisdiction betrays the sallow emptiness of their shallow minds and futile attempts at politicizing the sacred. Appearing to be erudite and wise does not make them so. No matter what they or anyone else says, the acronym BIBLE still means Basic Instructions Before Leaving Earth. There is no other compass than the Word of God as expressed in Genesis 2:24: “That is why a man leaves his father and mother and clings to his wife, and the two of them become one body.” Echoing queries about an attendant problem arising from the Supreme Court ruling on same-sex marriage, a curious church member asked, “What would you do if a same-sex couple asked you to preside over their wedding?” Respectfully, that is elementary, as Canon 1057 §2 states, “Matrimonial consent is an act of the will by which a man and a woman mutually give and accept each other through an irrevocable covenant in order to establish marriage.” It has been a personal sadness to me that Catholic priests are not even allowed to preside over the wedding of a dear Protestant friend, unless the partner of that friend is Catholic. In that latter case, a priest has jurisdiction over the couple. Virtually all our families have one or the other homosexual among our kin. We do not consider them outcasts, but our own flesh and blood, siblings also in Christ, striving with us to be all we can be and “have life to the full.” (John
10:10) “God is love, and all who abide in love abide in God and God in them.” (1 John 4:16)
