Sergio Says… We are dedicating this newsletter in loving memory of one of my favorite clients, whose life ended in a sudden, shocking tragedy. Our thoughts and prayers go out to her family during this difficult time.

We are even more saddened about this tragedy because she had recently hired us to draft an extensive and important Estate Plan consisting of a Last Will and Testament, a Living Trust, as well as various other Powers of Attorney, all of which provided explicit instructions about how she wanted things settled in the event of her passing. This included caring for two siblings who were suffering from debilitating illnesses and relied on her financially. Her Estate Plan would have assured that her wishes were fulfilled, while protecting her family from further hardship in the wake of her death. All that was needed to complete her plan was her signature on a few documents, and everything would have been finalized. However, she never made it into the office to sign her documents because she was involved in an auto accident that suddenly took her life, and we are heartbroken. Now because there are no directives in place, her entire estate will be held up in Probate Court. That means that a judge (who didn’t know or care about her wishes or her family) will decide how her assets will be distributed without regard to her siblings’ needs, which may expose the family to litigation (although we hope this will not be the case). This is not what our client wanted. The sudden loss of our dear client is a stark reminder to all of us that not a second on this Earth is guaranteed. This devastating event should remind all of us to think about how we want things handled after we are gone, and to make a plan for it now. I’m sure that you have thought about the importance of an Estate Plan in your own lives, and maybe it’s on your “to-do” list. We urge you not to wait. Our deepest sympathies are with our client’s family during these trying times. May she rest in peace.

la memoria de una de mis clientes favoritas, cuya vida terminó en una repentina, impactante tragedia. Nuestros pensamientos y oraciones van para su familia durante este tiempo difícil. Estamos más tristes sobre esta tragedia porque recientemente nos había contratado para elaborar un extenso e importante Plan Patrimonial que constaba de una Última voluntad y Testamento, un fideicomiso en vida, así como varios otros Poderes, los cuales todos proporcionaban instrucciones explícitas sobre cómo ella quería los asuntos resueltos en el caso de su muerte. Esto incluía el cuidado de dos de sus hermanas que estaban sufriendo de enfermedades debilitantes y dependían de ella económicamente. Su Plan Patrimonial habría asegurado que sus deseos se cumplieran, mientras protegería a su familia de otras dificultades a raíz de su muerte. Todo lo que se requería para completar su plan era su firma en algunos documentos, y todo se habría finalizado. Sin embargo, ella nunca llegó a la oficina a firmar sus documentos porque estuvo involucrada en un accidente automovilístico que tomó su vida de repente, y estamos desconsolados. Ahora debido que no hay directivas establecidas, su Patrimonio pasará por un Tribunal Testamentario. Esto significa que un juez (que no sabía o preocupaba por sus deseos o su familia) va a decidir cómo se distribuirán sus bienes sin tener en cuenta las necesidades de sus hermanas, lo cual puede exponer a la familia a litigios (aunque esperamos que este no sea el caso). Esto no es lo que nuestra cliente quería. La pérdida repentina de nuestra estimada clienta es un claro recordatorio de que ni un segundo en esta tierra está garantizado. Este evento devastador debería hacernos pensar a todos en cómo queremos las cosas arregladas cuando no estemos, y a hacer un plan para ello ahora. Estoy seguro que usted ha pensado en la importancia de un Plan Patrimonial en su propia vida, y tal vez está en su lista de "tareas". Le instamos que no espere. Nuestro más sentido pésame va a su familia durante estos tiempos difíciles. Que descanse en paz.
