TO THE VOTERS OF TUCSON UNIFIED SCHOOL DISTRICT NO. 1 On Tuesday, November 4, 2014, a Special Election will be held in the Tucson Unified School District No. 1 of Pima County, Arizona. Registered voters of the Tucson School District will have the opportunity to vote on an important financial matter.
The registered voters of Tucson Unified School District will be asked approval to authorize the District to sell, lease, or exchange school district property. Your responsibility will be to indicate whether this authority should be approved. This voter information pamphlet is provided to help you make an informed decision. Please review the information carefully and cast your vote on ELECTION DAY – NOVEMBER 4, 2014. This issue will be on your ballot as: PROPOSITION 420 By casting your vote, you will fulfill a vital civic duty to your school district to determine a course of action that is consistent with your wishes for the education of the students of your community.

A STATEMENT AS TO WHY A SALE OF PROPERTY ELECTION HAS BEEN CALLED
This election seeks voter approval to provide the Tucson Unified School District with authority to sell or lease nine schools that were closed in 2013 to more efficiently provide services to students.
State law requires school districts to obtain voter authority to sell real property or to lease it for a long term. The authority given by voters does not require that property be sold. A school
district may determine that a sale or lease or of property is not in the district’s or a particular community’s immediate best interests; later, if conditions become favorable, the district will have the authority, following established policy, to take action.
State law further restricts the use of the proceeds of any such sale of real property to pay outstanding bonds, improve and furnish existing schools, purchase school sites, or reduce
taxes. Therefore, any gains from these sales must be used to benefit students with improved school facilities, or to benefit taxpayers with reduced district bond debt or lower taxes.
TUSD has placed this item on the ballot to make the best use of its assets to meet the needs of students and communities.

TUCSON UNIFIED SCHOOL DISTRICT NO. 1 SPECIAL ELECTION- NOVEMBER 4, 2014 Arguments in Favor of Proposition No. 420 In 2013, TUSD closed some schools that cost more to operate than revenues received to support them.
To generate revenues, reduce maintenance costs and/or provide needed
services, two of the closed schools were leased and two were repurposed as self-supporting
Early Learning Centers. Another reopened as a K-8 school transforming from a D to a B school.
Some, as the community around them changes and as funds become available to bring them to
21st-century standards, may again serve students. Others may remain vacant with limited
potential for future use. In spite of being secured, vacant sites cost money to maintain and remain a liability to TUSD and surrounding neighborhoods.
State law allows voters to authorize TUSD to sell properties, with proceeds to be used to reduce bond debt or taxes, or improve existing schools. Sales follow established procedures. For previous sales and leases, TUSD informed and involved community groups; worked with
the City to ensure the uses fit the community; based sales on at least two appraisals by qualified appraisers; and, to be transparent, presented them in open, public sessions.

TUSD is being shortsight in selling off or exchanging school properties. Where school children live changes back over time. For schools that have lower enrollments for a time, the district can lease out part of the building for other uses or school like they are proposing for Menlo Park with a lease to Prescott College. Leasing parts of building also helps pay the bills while keeping a neighborhood school open, cuts cost of busing children, allows children to get exercise by walking to the school near them, provides space for meetings or neighborhoods and other groups. TUSD needs to be innovative towards making their schools better. With the $317,000,000 TUSD will receive from the state, TUSD can reopen the schools they have closed, hire more quality teachers and principlas like at Rose Elementary for all schools, have smaller classrooms which can compete with charter schools and keep public schools available to the community. Don’t give blanket permission to TUSD to sell off TUSD properties as they have made poor decisions like closing schools while building other schools within a half mile of another TUSD school. Recent stories in the Arizona Daily Star revealed serious concerns related to the award of school contracts and the hiring of a relative of a TUSD School Board member. The matter has resulted in a request for an investigation by a TUSD School Board member of the Arizona Attorney General’s Office.
In view of the above situation should we be giving the TUSD administration authority to sell or swap school properties to private parties? TUSD already has the authority to lease out schools which would be a more appropriate action to take. They can lease underoccupied school to Charter and JTED schools, and Pima College for educational purposes. That way as neighborhoods change and parents and children move back into a neighborhood, those schools can return to their original use. Closing schools requires busing kids out of their neighborhoods, increasing the cost for buses, drivers, fuel, maintenance, and bus barns while adding nonproductive time to the school day. All these costs don’t serve to educate kids one iota. Just say NO to this bad idea of permanently selling or swapping our neighborhood schools.

Vote Against Selling of TUSD Schools
Public Schools serve dual purposes. Their primary mission is the education of our children. However, just as important schools are part of the social fabric that defines barrios and neighborhoods. The recent closer of TUSD schools heavily impacted the Westside communities. Now TUSD is asking for carta blanca authorization to sell schools, if needed at some future date. As a taxpayer and resident of the Brichta School area, I oppose this proposition. By giving authorization, as stakeholders of targeted schools, we lose our ability to have a voice at the table. Recently Menlo and Brichta schools were “retooled,” one as an early learning center and the other slated to house Prescott College. These plans are applauded by the respective neighborhoods because TUSD engaged the community in the decision making. If we disagree with a TUSD Board mandate, we can vote Board members out of office. However once authorization is given and ownership lies with a private developer, we have no recourse. Vote no on this proposition, the current system is working. Raul E. Ramirez

The wording of this proposition is deceptive, and it should be rejected for that reason alone. A voter reading this proposition might vote “Yes”, thinking that TUSD definitely should be allowed to lease school properties that have been closed.
But, TUSD already has authority to lease without this proposition. They have leased a number of properties, some at a taxpayer crushing $1 per year. One $1 lessee subleased at market value, making a huge profit, but not for the taxpayers. What TUSD really wants, and what this proposition should ask is, should TUSD be allowed to SELL the properties. The answer to that is a resounding NO. 1) 2) 3) 4)
It is a terrible time to sell real estate. The schools can be leased, until the next cycle of kids comes along. TUSD has an abysmal record in real estate matters. If it becomes necessary to reopen a school, it will cost the taxpayers a fortune to acquire vacant space and build a new one. 5) TUSD could try creative solutions, such as keeping part of a school open and leasing the rest, not that they’ve ever done anything creative.

Just from an invesment point of view, the sale of the above parcels of real properties now, because of their low market values, would be a bargain for any investor or developer. The more common sense is to lease the properties (which TUSD is already doing and has that power) so they pay for themselves and actually make a profit.
These Schools (paid by our hard earned tax dollars) can still be used for Pre-School, Troubled Teens or Adult Education; as we know, constant education is necessary and is the essence of a intelligent Society; beside, with Tucson growing and its changing demographics, these school buildings may be needed in the near future.
The Governing Board and TUSD is short sighted in selling these schools, in spite of budget constraints, justice is prevailing, the courts have recently ruled back revenues owed to TUSD schools in the amount of $317,000,000.00, this should be incentive and motivation for the Governing Board and TUSD instead of selling, to hold on to these school properties for further education of Tucsonans, to maintain our Free and Intelligent Democracy. TUCSON UNIFIED SCHOOL DISTRICT NO. 1 SPECIAL ELECTION- NOVEMBER 4, 2014 Arguments Against Proposition No. 420 (cont’d) The sale of public assets should always be undertaken cautiously. The TUSD board needs policy that assures transparency, oversight and accountability even when it comes to selling off school property. Vote NO on pre-approval of school property sales unless: a) a detailed TUSD Board policy is written that mandates community/neighborhood input into the sale; b) an internal auditor is available to oversee the use of funds and; c) an agreement is reached with the City over the reuse of significant TUSD properties. When schools are closed permanently, demographics change, property values change and the neighborhoods may be negatively affected. While the need for capital improvement funds is urgent, it is shortsighted to sell off properties without a comprehensive analysis of the broader impact that might have.
Although the District has been closing and selling schools for many years, they do not track subsequent neighborhood changes and the process remains far from transparent. A No vote still allows the District to lease a property for up to ten years: a re-use options that allow the re-opening of the school when students return to the neighborhood or to the district.

TUSD rents some closed schools for $1.00 per year. A lessee can then sublet. In the case of former Wakefield Middle School, for example, the sublessee is charged $1,000.00 per month, as rent, payable to the lessee, not TUSD! The sublessee has the right to “Extended Terms.” There is no bidding process regarding who gets to take advantage of such special deals and benefits substantially. These extremely valuable TUSD properties belong to us.
Proposition 420 is purposely vague: it would allow carte blanche approval for further disposition of prime real estate, with no specifics as to whether properties would be sold, swapped, or leased. There could be additional declines in property values and rezoning as a result. This proposition impacts the Federal Court Order, since it affects land/development issues, locations of schools, sites for future schools, boundaries, curriculum and equity. New executive positions, with hefty stipends, bonuses, and benefits, are added annually to the TUSD Superintendent’s “Cabinet,” when families and the community are asked to donate basic school supplies, and TUSD scraps the computer software system (ERP), just recently purchased, an acknowledged $10 million dollar loss in software alone. PROPOSITION 420: ANOTHER BLANK CHECK TO TUSD PLEASE VOTE NO!

WHERE TO VOTE: Your polling place may have changed! Your polling place for this election is listed on the back cover of this Information Pamphlet. WHEN TO VOTE: The polls are open from 6:00AM to 7:00PM on Election Day. Any qualified voters who are in line to vote at 7:00PM shall be allowed to prepare and cast their ballot.

EARLY VOTING: Any registered voter can vote early in the November 4, 2014 Special election either in person or by requesting an early ballot from the Pima County Recorder’s Office by calling (520) 724-4330. In person voting: Individuals who are eligible to vote in this election and who wish to vote an early ballot in person may vote at the Pima County Recorder’s Office at 115 N Church Ave, Tucson 85701. In person voting begins on October 9, 2014 and continues through 5:00PM on Friday, October 31, 2014 at the Pima County Recorder’s Office or other designated Early Voting Satellites used for this election. Early ballots: You may request an Early Ballot beginning 90 days prior to an election by calling the Pima County Recorder’s Office. The last date to request an Early Ballot is 11 days before the
Election, which is October 24, 2014. You may request an Early Ballot through one of the following:

Permanent Early Voter List (PEVL): For information on the Permanent Early Voter List, please contact the Pima County Recorder’s Office at (520) 724-4330 or to their website www.recorder.pima.gov and click on “Permanent Early Voter List” (PEVL). You must make a written request specifically asking to be on the PEVL. If you choose to participate, you will automatically receive an Early Ballot for every election that you are eligible to participate in without the need to request an Early Ballot for each election.
Early Ballot Deadline: In order to be valid and counted, all Early Ballots must be received by the Pima County Recorder by 7:00PM on Election Day. Early Ballots may also be turned in on Election Day to any polling place or the Pima County Recorder’s Office. Emergency Voting: Emergency voting is available on Monday, November 3, 2014, from 8:00AM to 5:00pm for any qualified elector prevented from voting at the polls as a result of an emergency. Any emergency voter is a person who discovered after the close of early voting that they will not be able to vote at their polling place for some reason. Emergency voting is always available on the Monday prior to Election Day at the Pima County Recorder’s Office located at 115 N. Church Ave. Tucson, AZ. “Emergency” means any unforeseen circumstance that would prevent the elector from voting at the polls. Contact the Pima county Recorder’s Office for additional information Emergency Voting.

IDENTIFICATION AT THE POLLS Every qualified elector is required to show proof of identity at the polling place before receiving a ballot. The elector shall announce his/her name and place of residence or present the elector’s name and resident in writing to the election official. The elector shall present acceptable identification that:
1. Bears the name, address, and photograph of the elector (See List 1), or 2. Two different forms of identification that bear the name and address of the elector (See List 2), or 3. One form of acceptable photo identification with one form of non-photo identification that bears the name and address of the elector (See List 3)
A voter who does not provide one form of identification from LIST 1; two different forms of identification from LIST 2; or a combination of identification from LIST 3 shall not be issued a regular ballot, but shall receive a conditional provisional ballot. The voter will have until 5:00PM on the fifth business day for a federal General Election and will have until 5:00PM on the third business day after any other election to provide sufficient identification to the County Recorder in order for their conditional provisional ballot to count. All forms of identification are deemed valid unless it can be determined on its face that it has expired.
List 1 - Acceptable forms of identification with photograph, name, and address of the elector: •Valid Arizona driver license •Valid Arizona non-operating identification license •Tribal enrollment card or other form of tribal identification •Valid United States federal, state, or local government issued identification List 2 - Acceptable forms of identification without a photograph that bear the name and address of the elector (two required): •Utility bill of the elector that is dated within 90 days of the date of the election. A utility bill may be for electric, gas, water, solid waste, sewer, telephone, cellular phone, or cable television •Bank or credit union statement that is dated within 90 days of the date of the election •Valid Arizona Vehicle Registration •Indian census, tribal enrollment, or other form of tribal identification card •Property tax statement of the elector’s residence •Tribal enrollment card or other form of tribal identification •Arizona vehicle registration •Arizona vehicle insurance card •Recorder’s Certificate •Voter registration card •A valid United States federal, state or local government issued identification or any mailing that is “official election material”. UNA DECLARACION ACERCA DE POR QUÉ HA SIDO CONVOCADA LA ELECCION PARA VENDER, ARRENDAR O INTERCAMBIAR UNA O MAS PARCELAS DE BIENES RAICES
Esta elección busca la aprobación de los electores para prestar al Distrito Escolar Unificado de Tucsón con la autoridad de vender o arrendar nueva escuelas que fueron clausuradas en el 2013 para dar servicios a los estudiantes de manera más eficiente.
Las leyes del estado requieren que los distritos escolares obtengan la autoridad de los electores para vender bienes raíces o para arrendar a plazo largo. La autoridad dada por los votantes no requiere que las propiedades se vendan. Un distrito escolar puede determinar que una venta o arrendamiento de una propiedad no es en el mejor interés inmediato del distrito o de una comunidad en particular. Después, si las condiciones son favorables, el distrito tendrá la autoridad, siguiendo las pólizas establecidas, para tomar acción. DISTRITO ESCOLAR UNIFICADO NUM. 1 DE TUCSON ELECCIÓN ESPECIAL – 4 DE NOVIEMBRE DE 2014 Argumentos a favor de la Proposición Núm. 420 En el 2013, TUSD cerró algunas escuelas donde costaba más operarlas que los ingresos recibidos para apoyarlas. Para generar ingresos, reducir gastos de mantenimiento y/o proveer servicios necesitados, dos de las escuelas cerrados fueron arrendadas y otras dos fueron reutilizadas como autoportante Centros de Enseñanza Temprana. Otra se abrió como escuela de grados K-8 transformando de una escuela con grade de D a B. Unas, cuando la comunidad que las rodea cambie y los recursos financieros estén disponibles para actualizarlas a los estándares del siglo 21, tal vez podrán servir a los estudiantes. Otros tal vez quedarán vacantes con potencial limitado para uso en el futuro. A pesar de estar asegurados, los sitios vacantes cuestan dinero para mantener y son una responsabilidad financiera a TUSD y a los barrios de alrededor. Las leyes estatales dejan que los votantes autoricen a TUSD a vender propiedades, con los ingresos que se utilicen para reducir la deuda en bonos o reducir los impuestos, o mejorar las escuelas existentes. Las ventas siguen un proceso establecido. Para venta y arrendamientos previos, TUSD informó e involucró a los grupos comunitarios; trabajo con la Ciudad para asegurar que los usos se conformen a la comunidad; se basaron las ventas en al menos dos avalúos por valuadores calificados; y, para ser transparente, se presentaron en sesiones abiertas al público. TUSD está siendo miope en vender o intercambiar propiedades escolares. El lugar donde viven los niños de la escuela cambia con el tiempo. Para las escuelas que tienen matrículas más bajas durante un tiempo, el distrito puede arrendar una parte del edificio para otros usos o las escuelas como lo están proponiendo para Menlo Park con un contrato de arrendamiento a Prescott College. Arrendando partes del edificio también ayuda a pagar las facturas mientras se mantiene una escuela de barrio abierta, reduce gastos de transporte escolar para los niños, permite a los niños a hacer ejercicio por medio de caminar a la escuela cerca de ellos, ofrece un espacio para las reuniones de barrios y otros grupos. TUSD necesita ser innovador para mejorar sus escuelas. Con $317,000,000 dólares que TUSD recibirá del Estado, TUSD puede volver a abrir las escuelas que han cerrado, contratar a más maestros de calidad y directores para todas las escuelas como el de la Escuela Primaria Rose, tener aulas más pequeñas que pueden competir con las escuelas chárter y mantener las escuelas públicas a disposición de la comunidad. No le dé permiso general a TUSD a vender propiedades de TUSD ya que han hecho malas decisiones como el cierre de escuelas mientras que construyen otras escuelas dentro de una media milla de otra escuela de TUSD. Historias recientes en el Arizona Daily Star revelan serias preocupaciones relacionada con la adjudicación de contratos escolares y la contratación de un familiar de un miembro de la Junta de Gobierno de TUSD. El asunto ha dado lugar a una solicitud de investigación por un miembro de la Junta de Gobierno de TUSD a la Oficina del Procurador General de Arizona.
A resultado de la situación anterior, ¿deberíamos dar la autoridad a la administración de TUSD para vender o intercambiar propiedades escolares a personas privadas? TUSD ya tiene la autoridad para arrendar las cuelas que sería una acción más apropiada. Ellos pueden arrendar escuelas subocupada a escuelas Charter y JTED y el Colegio Pima con fines educativos. De esa manera como los barrios cambian y los padres y los niños se mudan de nuevo a un barrio, las escuelas pueden volver a su uso original. El cerrar las escuelas requiere transportar a los niños fuera de sus barrios, incrementa los gastos de los camiones, los conductores, la gasolina, el mantenimiento y los garajes de camiones mientras se agrega tiempo no productivo al día escolar. La redacción de esta proposición es engañosa, y debería ser negada solamente por esta razón. Un votante que lea es proposición tal vez vote “Sí”, pensando que TUSD definitivamente debería podrá arrendar propiedades escolares que ahora están cerradas.
Pero, TUSD ya tiene la autoridad de arrendar sin esta proposición. Han arrendado una cantidad de propiedades, algunos a un dólar por año. Un arrendatario de $1 subarrendó usando el valor comercial, haciendo un beneficio económico enorme, pero no para los contribuyentes.
Lo que TUSD realmente quiere, y lo que esta proposición debería pedir, debería TUSD poder VENDER las propiedades. La respuesta a eso es un resonante NO. 1) 2) 3) 4)
Es un tiempo terrible para vender bienes raíces. Las escuelas pueden ser arrendadas, hasta que el próximo ciclo de niños venga en camino. TUSD tiene una pésima historia en materia de bienes raíces. Si es necesario volver abrir una escuela, le costará una fortuna a los contribuyentes adquirir un espacio y construir una nueva escuela. 5) TUSD podría tratar soluciones creativas como manteniendo una parte de la escuela abierta y arrendar la otra parte, pero no es como si ellos hacen algo creativo.

Solamente de un punto de vista inversionista, la venta de las parcelas de bienes raíces hoy, solamente porque los valores del mercado son bajos, serían una ganga para cualquier inversionista o promotor. El sentido común sería de arrendar las propiedades (cual TUSD ya está haciendo y tiene la autoridad de hacerlo) para que se paguen por sí mismos y en realidad hacen un beneficio económico.
Estas Escuelas (pagadas con nuestros dólares de impuestos ganados con mucho esfuerzo) pueden usarse como Pre Kínder, Adolescentes con Problemas o la Educación de Adultos; ya sabemos que la educación constante es necesaria y es la esencia de una sociedad inteligente; además, con el desarrollo y el cambio demográfico de Tucsón, estos edificios escolares podrán ser necesitados en el futuro no muy lejano. La Junta de Gobierno y TUSD son miopes en la venta de estas escuelas, a pesar de las limitaciones presupuestarias, la justicia se está imponiendo, las cortes han revertido recursos debidos a las escuelas de TUSD en una cantidad de $317,000,000 de dólares, esto debería ser estímulo y motivación para la Junta de Gobierno de TUSD en vez de vender, de aferrarse a estas propiedades escolares para mejorar la instrucción de los tucsonenses, para mantener una democracia libre e inteligente. DISTRITO ESCOLAR UNIFICADO NUM. 1 DE TUCSON ELECCIÓN ESPECIAL – 4 DE NOVIEMBRE DE 2014 Argumentos en contra de la Proposición Núm. 420 La venta de bienes públicos siempre debería de hacerse cuidadosamente. La Junta de TUSD necesita una póliza que asegure la transparencia, la supervisión y rendición de cuentas aunque sea en la venta de propiedades escolares.
Vote NO a la pre-aprobación de la venta de propiedades escolares a le menos que: a) haya una póliza detallada de TUSD por escrita que demande contribuciones de la comunidad/barrio acerca de las ventas; b) una auditor interno que esté disponible a supervisar el uso de los fondos y; c) un acuerdo con la ciudad sobre el reutilización de propiedades significativas de TUSD. Cuando las escuelas cierran permanentemente, las demográficas cambian, los valores de propiedades cambian y los barrios son afectados negativamente. Aunque la necesidad de fondos de mejoras de capital es urgente, sería miope vender propiedades sin un análisis exhaustivo del impacto amplio que podrían tener. Aunque el Distrito ha cerrado y vendido escuelas por varios años, ellos no siguen los cambios subsecuentes en los barrios y el proceso es lejos de ser transparente. Un voto No dejará que el Distrito sigua arrendando propiedades por un plazo de hasta diez años: una opción de re-uso que dejaría volver a abrir la escuela cuando los estudiantes regresen a los barrios o al distrito. Vote En Contra de la Venta de la Escuelas de TUSD
Las escuelas públicas sirven dos propósitos. La misión primaria es la educación de nuestros niños. Pero, son igual de importantes las escuelas como parte del tejido social que define los barrios y vecindarios. La reciente clausura de las escuelas de TUSD fuertemente impactó las comunidades del lado oeste de la ciudad. Ahora TUSD pida autorización carta blanca para vender escuelas, si es necesario en una fecha en el futuro. Como contribuyente y residente del área de la Escuela Brichta, me opongo a la proposición. Al dar autorización, las partes interesadas de las escuelas seleccionadas pierden la habilidad de tener una voz en la decisión. Recientemente las escuelas Menlo y Brichta fueron reestructuradas, una como un centro de aprendizaje temprano y otro para Prescott College. Estos planes son aplaudidos por los barrios respectivos porque TUSD involucró a la comunidad en la decisión. Si estamos en desacuerdo con un mandato de TUSD, podemos destituir a los miembros de la Junta. Pero cuando la autorización se le da y se adueñe un propietario privado, no tenemos ningún recurso. DISTRITO ESCOLAR UNIFICADO NUM. 1 DE TUCSON ELECCIÓN ESPECIAL – 4 DE NOVIEMBRE DE 2014 Argumentos en contra de la Proposición Núm. 420 TUSD alquila escuelas por un dólar por año. Un arrendatario puede subarrendar. Por ejemplo, en el caso de la antigua Escuela Media Wakefield, el subarrendatario se le cobra $1000 dólares mensualmente, como renta, que se les deba a los arrendatarios, ¡no a TUSD! El subarrendatario tiene el derecho a “Términos Extendidos.” No hay ningún proceso de licitación para considerar quién va tomar sustancialmente ventaja de estas ofertas y beneficios especiales. Estas propiedades de TUSD de gran valor son de nosotros.
La Proposición 420 es vaga a propósito: daría aprobación de carta blanca para la disposición de bienes raíces de primera, sin específicas si las propiedades serán vendidas, intercambiadas o arrendadas. Como resultado podría haber disminuciones adicionales en los valores de propiedad y rezonificación. La proposición impacta la Orden del a Corte Federal, ya que afecta a cuestiones de tierras/desarrollo, la ubicación de las escuelas, sitios para escuelas en el futuro, las fronteras, el currículo y la equidad.
Nuevas posiciones ejecutiva con estipendios grandes, bonos y beneficios son agregados anualmente al Gabinete del Superintendente de TUSD, cuando a las familias y la comunidad se les piden útiles escolares básicos, y TUSD cierra el sistema informático (ERP), que fue recientemente adquirido, una pérdida reconocida de $10 millones de dólares en el sistema solamente.
