This has reference to your First Official Examination Report No. ER/1720 dated 9' September 2004 and our response dated 27' November 2004. We now send our response as follows : 1. Absolute Grounds for Refusal (Section 9): We note that an objection has been taken under Section 9 on the ground that the mark is devoid of any distinctive character as the mark is the trading style of the applicants. The objection raised is not maintainable as under the new Act of 1999, the trading style has not been specifically debarred from registration. In our humble submission the trading style or a part of the trading style of an applicant for registration could be very well used to distinguish the goods or services if it has been represented in a special or particular manner to give it visual distinctiveness in identifying and distinguishing it from other similar trading styles, or the trading style has for its prominent feature a coined or an invented word or a word which has no reference to the goods. In the instant case the mark submitted for registration consists of a label with a logo and the words ESMALTES, SA. The logo being a visual device gives inherent distinctiveness to the mark. Further, it is also not proper to split the mark and then take objection to a portion of the mark. The proper determination should be by taking the mark in its totality. In totality, the applicants mark cannot be deemed to be the trading style as the mark has inherent distinctiveness due to the presence of the artistically created logo.
