Don’t just look at the obvious heading Think about the services supply chain and input services Look at the GATS list (W/120) to see what services are relevant Go to the UNCPC website and see what each of them covers
A service like health has many different services. Some sectors do not have classifications in the GATS list (eg water) but that does not mean they are excluded altogether Some services may be covered by several sectors: Is Amazon a computer service, a retail service or a logistics service?
Some may be affected by unexpected commitments, eg. Venezuela did not commit energy services, but did commit computer services

How schedules are negotiated Each party’s schedule is negotiated bilaterally Every TiSA party asks every other TiSA party to make certain commitments The receiving party replies each country’s ‘request’ with an ‘offer’ That process is repeated several times Each offer is expected to give more than the previous one These bilateral offers are bundled together so all TiSA parties get the benefit of the offers made to every other party. That becomes the party’s schedule Currently all TiSA countries except Pakistan have tabled their second offer They are now negotiating to ‘improve’ them

How the bargaining process works in TiSA Some countries have more bargaining power than others so they can defend their sensitive services and policies, and block other countries from doing the same. Parties are being asked to commit at least as much as in their ‘best’ FTA even though that was usually part of a much bigger negotiation or it may have more significant impacts when it is given to all TiSA parties. TPPA parties are making the same promises in TiSA. Some proposed annexes say a party must make certain commitments, but most of those annexes are not agreed yet. As with GATS, TiSA schedules will be almost impossible to change.

There are 2 main approaches to scheduling: positive list and negative list (Deborah slide 29) A ‘positive list’ (as in GATS) sets out each service sub-sector that is subject to the • market access rule and/or • national treatment rule separately for each of the 4 modes and any limitations on the extent of those commitments with a horizontal layer at the top that applies to all the subsectors. When you look at the next example of how a positive list schedule would make commitments on environmental services, the most important point is that the word ‘none’ means there is no limitation on the commitment, NOT that there is no commitment.

TiSA’s scheduling TiSA adopts a 3rd, hybrid approach: • positive list for commitments on market access, subject to limitations, the same as the GATS; and • negative list for national treatment with either (i) a policy space reservation, or (ii) a standstill at current levels of liberalisation and a ratchet to lock in future liberalisation. Some annexes propose a negative list for both rules (eg delivery) or making commitments compulsory (energy).

How to compare your country’s schedules Every agreement that covers services will set out the structure and rules for a Party’s schedule Different agreements have different rules and structures That creates problems of comparisons and increases the risk of mistakes. To see what is new for your country in TiSA you will need to look at your • GATS schedule • schedules or annexes in your country’s various bilateral and regional FTAs, including any concluded that have been abandoned, eg TPPA • the EU’s requests made under TiSA that have been leaked • anything else you can find!
