I agree the school, its teachers, staff, administrators, employees and agents would not be liable directly or indirectly for any claim of personal injury or property damage which may arise as a result of the abovenamed student’s participation in the voluntary transportation program. I further agree to hold the district, its teachers, administrators, employees and agents harmless from any and all such claims which may arise as a result of the student’s participation in the voluntary transportation program. ----------------------------------------------------------------------------------------------------------------------------------------------RECOMMENDATIONS TO DRIVERS TRANSPORTATION FOR EXTRACURRICULAR EVENTS Recommendations for parents/guardians who use their cars or other vehicles to transport students to and from school events: 1. Check to see that you have a valid driver’s license. 2. Check safety of the vehicle. Tires, brakes, lights, horn, suspension, etc. A safety check of the type conducted by the California Highway Patrol is recommended. 3. Check the adequacy of your liability insurance. You are liable in the event of illness, accident, injury, or death resulting from such use of your vehicle. State law states that “all persons making any field trip or excursion shall be deemed to have waived all claims against the district (its employees) or the State of California for injury, accident, illness, or death occurring during or by reason of the field trip or excursion.” (Education Code 35330) 4. Carry only the number of passengers for which your vehicle was designed. The number of occupants in a sedan, passenger vehicle, station wagon, or van including driver, may not exceed eight. (Education Code 39830). Each Passenger should be required to use a safety belt, if available. 5. The number of occupants in a pickup or motortruck may not exceed more persons than can safely sit in the passenger compartment. Motor homes may not be used to transport students. Students are expressly forbidden to ride in the cargo area of pickups or motortrucks whether or not these areas are enclosed by camper shells or other protective covering. -----------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------RECOMENDACIONES PARA LAS PERSONAS QUE TRANSPORTAN ESTUDIANTES TRANSPORTACION PARA LOS EVENTOS EXTRACURRICULARES Recomendaciones para los padres/tutores que usan sus carros u otros vehículos para transportar estudiantes a los eventos escolares: 1. Revise que su licencia de manejar sea válida. 2. Revise la seguridad del vehículo: Llantas, frenos, luces, bocina, suspension, etc. Se recomienda que se haga una revision del tipo que conduce el Departamento de Vehículos California Highway Patrol. 3. Revise la suficienca de su seguro de responsabilidad civil. Usted es responsable en caso de enfermedad, accidente, heridos o muertes que resulten del uso de su vehículo. La ley estatal establece que “todas las personas que están haciendo viajes o excursions han renunciado al derecho de hacer demandas en contra del distrito (y sus empleados) o al Estado de California por causa de heridos, accidentes, enfermedades o muertes que hayan sucedido durante o debido a viajes o excursions.” (Código Educativo #35330). 4. Transporte únicamente el número de pasajeros que sea apropiado para su vehículo. El número de pasajeros en un sedan, vehículo de pasajeros, camioneta o camion (“van”) incluyendo al chofer no debe de exceeder más de 8 personas. (Código Educativo #39830). 5. El número de pasajeros en un camiόn de carga (“pick-up”) o en una autocamión no debe de exceeder más personas que las que se puedan sentar con seguridad en el espacio destinado para los pasajeros. No se permitirá el uso de casas motor (“motor homes”) para transportar estudiantes. Se les prohibe a los estudiantes viajar en el area de la carga de los camiones de carga (“pick-up”) o de los autocamiones, aunque los camiones estén cubiertos (“camper shells”).
