1. REGULATION IN FORCE 1.1. CONSTITUTION OF AENA Aeropuertos Españoles y Navegación Aérea was created as a Public Entity through Article 82 of the Law 4/1990, 1990, June, 29th, about National Budget and is ruled by its own Statute approved trough Real Decreto 905/1991, 1991, June, 14th.

1.3. PROCEDURE TO OPERATE AT SPANISH AIRPORTS Every flight landing, taking-off or flying over Spanish territory will be subject to Public Security regulation in force in Spain. Information about requirements and authorizations needed to operate in Spain is available in AIP ESPAÑA GEN. 1. To optimise the use of the capacities available in airports under Spanish sovereignty it is needed to co-ordinate arrival and departure hours of every commercial flight to avoid congestions and delays. RULES GOVERNING THE ACTIVITY OF AENA In complying with its functions, Aena is governed by the conditions of its Statutes, approved by Real Decreto 905/1991, of 14 June, subsequently amended by Real Decreto 1993/1996 of 6 September, Real Decreto 1711/1997 of 14 November and Real Decreto 2825/1998 of 23 December. Charges induced by the use of facilities and airport/air navigation services as a result of the aeronautical activity and non-aeronautical operations, are ruled by the following standards:

1.5. AENA CHARGES AND THE EURO LEGISLATION Calculations for invoicing purposes are under dispositions of Law 46/1998 of December, 17th. Since 2006, January 1st, and only for those charges collected trough machines Aena is entitled to round applicable fees to the closest multiple of five cents of euro. 1.6. AIRPORT CLASSIFICATION 1.6.1. CLASSIFICATION APPLICABLE TO LANDING CHARGE First class airports: Alicante, Barcelona, Bilbao, Fuerteventura, Gran Canaria, Lanzarote, Madrid-Barajas, Málaga, Palma de Mallorca, Sevilla, Tenerife Norte, Tenerife Sur and Valencia. 2. CHARGES FOR AIRPORT SERVICES Indirect taxes will be applied on the amounts set up, according to regulations in force.

2.1. LANDING CHARGE Definition It is required for the use of the runways by an aircraft, and the rendering of the services needed for such use different from ground handling to aircraft, passengers and goods. Taxpayer Airlines, Legal Entities or Natural Persons receiving the services above mentioned. Exemptions Spanish Government’s aircrafts are exempted of this fee. Foreign Government’s aircrafts are exempted only under reciprocity agreements. Rates It is required according to the maximum take off weight, and varies depending on the type and class of flight.

2.1.5. Surcharges according to the noise level of the aircraft Surcharges on landing charge (sections 2.1.1 and 2.1.4) will be applied at Alicante, Barcelona, Madrid Barajas, Málaga, Palma de Mallorca, Gran Canaria, Tenerife Sur and Valencia Airports, according to the noise level of each aircraft and to the schedule of the landing or take off:

The criterion applied to determine the noise category for each aircraft is as follows: Category 1: Aircrafts with accumulative margin up to 5 EPNdB. Category 2: Aircrafts with accumulative margin between 5 EPNdB and 10 EPNdB. Category 3: Aircrafts with accumulative margin between 10 EPNdB and 15 EPNdB. Category 4: Aircrafts with accumulative margin over 15 EPNdB. Accumulative margin: figure, in EPNdB, obtain after summing up the differences between noise calculated and noise certificated at each of the three points of reference defined in ICAO Annex 16, volume 1, second part, chapter 3. During 2009 year, noise surcharges in Alicante, Málaga, Palma de Mallorca, Gran Canaria, Tenerife Sur and Valencia Airports will be reduced by 65% and by 35% in 2010 year. Full rates will be applied since 1st January 2011.

Rates above include “F Factor”. This new charge has been approved since January 2009, for the financial of services related to baggage inspection and control services in the airport area provided by the Air Security State Agency, established since February 2008 by Real Decreto 184/2008. This new rate will be collected by Aena. The amount collected will be transferred to the Air Security State Agency. For information table below shows F Factor rates.

For those airports with no specific car park areas for employees, the general car area will be allowed to use applying the above-mentioned fares. For all kind of parking areas: In case of ticket loss, the amount corresponding to 5 days applying the “first four days” rate will be invoiced, unless real stay were justified; in this case, real stay will be charged.

2.22. Charge G.2.: SUPPLY OF ELECTRIC POWER, WATER, CONDITIONING AND OTHER SERVICES, MATERIALS AND VARIOUS PRODUCTS Definition It includes the real value of supplies, services, materials and products provided directly or indirectly by the airport, and the use of the airport property and the facilities and equipment needed to render them. 3. CHARGES FOR THE USE OF AIR NAVIGATION FACILITIES AND SERVICES 3.1. EN-ROUTE CHARGE Spain shares the EUROCONTROL en-route charges system, by which their invoicing and payment is entrusted to that Organisation. Definition It is the payment for the costs related to the facilities and services of en-route air navigation. The charge formula is as follows: ri = t x N Where ri is the total charge; t, the Spanish unit rate of the charge, and N is the number of service units (N = di x p, where p is the coefficient distance (great circle distance/ 100), and p is the coefficient weight ( MTOW / 50 ) 0,5 )

Exonerations The following classes of flights are exempted to pay the en-route charges: 

Flights performed by civil aircraft with a maximum take-off weight less than 2 metric tonnes.



The flights performed according to the rules of visual flight along the total phase en-route.



The flights ending in the departing aerodrome with no intermediate landing (round flights).



Search and rescue flights authorized by a SAR body.



Flights performed to verify the ground aids to the air navigation.



Training flights without a commercial function



Flights exclusively performed for the transport of Monarchs, Heads of State and Government, as well as Ministers in official mission.



Military flights from those countries having a reciprocity relation.

3.2. TERMINAL CHARGE Definition The terminal charge pays the air navigation services rendered to ensure security and fluidity of their movements in this stage of flight. The terminal charge is applicable at every airport and airfield opened to civil traffic. The approach and take-off operations are taken like a sole service with regard to this charge. Aena manages this charge.
