ENGLISH VERSION Vacation vs Staycation Sweepstakes Conditions of Entry & Contest Details This Contest is being held by Blurb. The Contest, which is being administered via the online platform Iconosquare, is in no way sponsored, supported or organized by Instagram/Iconosquare. All questions, comments and complaints regarding this Contest should be sent directly to Blurb and not to Iconosquare; this also applies to any claims arising from the administration of the Contest. Participation will take place exclusively online and is free of charge. Participation By entering this Contest, participants expressly accept these conditions of entry and the application of United States and California law. Anyone who is the minimum age of eighteen (18) at the time of entry, and who has a Instagram/Iconosquare account is eligible to enter the Contest. Participation in the Contest is not dependent on a purchase or on the use of services. Each participant may submit one (1) entry. Conditions of Entry During the Contest Period (September 1, 2016 at 12:01 AM PST through September 16, 2016 at 11:59 PM PST), participants are required to use the free photo sharing service, Instagram/Iconosquare, or direct upload to http://www.blurb.com/vacayorstaycay to upload a photo, which shows how they vacationed or staycationed. Each participant must tag their Instagram/Iconosquare upload with both #VacayOrStaycay and @BlurbBooks to be eligible in the Contest. Entries without both the hashtag and @BlurbBooks will not be eligible. The following Content Standards apply with respect to the content of the photo. Photos or artwork submitted must not:

1. Contain any material which is defamatory of any other person; 2. Contain any material which is obscene, offensive, hateful or inflammatory (or is of a sexually explicit nature) 3. Infringe any copyright, database right or trade mark of any other person (such as a photo of a copyright work, such as a painting or another photograph, taken without the owner’s permission) be likely to deceive any person 4. Be taken without the subject’s consent (or depict any subject under the age of 18 without their legal guardian’s consent) 5. Be likely to harass, upset, embarrass, alarm or annoy any other person; 6. Show or encourage risky or dangerous behavior; 7. Show or encourage discrimination based on race, sex, religion, nationality, disability, sexual orientation or age; 8. Show or encourage any illegal or immoral activity violence, racial hatred, cruelty to animals or any other anti-social or unlawful behavior of any kind; or 9. Give the impression that it emanates from, or is endorsed by, Blurb. If any photos breach the Content Standards or any applicable law, Blurb reserves the right to detag, take down, remove or delete (where possible) any such images. In any event, such photos (and the participant that posted it) shall be disqualified from the Contest. By uploading the photo, participants warrant and undertake that they are the legal and beneficial owner of all intellectual property rights in their photo and that it is their own original work and does not infringe any third party rights. Participants hereby waive and agree not to assert any moral rights in and in connection with the photo. All people pictured in the photo must agree to be featured and for the photo to be uploaded via Instagram/Iconosquare, or direct upload, and must also waive and agree not to assert any applicable moral or similar rights and agree to the photo being entered in the Contest and the entrants warrant that applicable consents have been obtained. These statements also extend to the Instagram/Iconosquare platforms used. By uploading the photo, participants grant Blurb and the companies associated with Blurb an irrevocable, transferable, worldwide, free right of use for two (2) years covering all methods of

use, in particular the use, distribution, reproduction, translation and modification of the photo and any accompanying text for commercial purposes by Blurb. The participant also accepts that all photos uploaded via Instagram/Iconosquare, Twitter and on the participating Facebook pages will feature in a photo gallery at http://www.blurb.com/vacayorstaycay on Blurb’s Website and on the Iconosquare website. These pages are updated in real time. This statement also extends to Instagram/Iconosquare. Prizes At the end of the Contest, three (3) winners will be selected by a panel. The winners will be announced through the Instagram/Iconosquare/Iconosquare Contest page as well as on the Blurb Facebook page and Blurb Twitter account. Entries will be evaluated on the following criteria: (1) Composition, (2) Lighting, and (3) Narrative. Grand Prize: The 1st place photo submission winner will receive a $1,000.00 USD Gift Card to use on a vacation of their choice. Additionally, the 1st place winner will receive a $500.00 USD gift card to use at Blurb.com. 2nd Place: The 2nd place photo submission winner will receive a $500.00 USD Gift Card to use on a staycation of their choosing. Additionally, the 2nd place winner will receive a $300.00 USD gift card to use at Blurb.com. 3rd Place: The 3rd place photo submission winner will receive a $200.00 USD gift card and a $100.00 USD gift card to use at Blurb.com Three (3) winners will be selected within three (3) weeks after the contest is completed. Exclusion from the Contest Employees of Blurb and of companies associated with Blurb as well as their family members and relatives are excluded from the Contest. People who (i) provide incorrect personal details, (ii) provide illegal content, or (iii) manipulate or otherwise misuse electronic devices created for the purpose of the Contest are excluded. Early Termination of the Contest Blurb is entitled to terminate the Contest at any time during the Contest period, without prior notice and without stating reasons. In particular, this applies in cases where this is necessary in one or more countries for organizational or technical reasons (e.g. computer system viruses, manipulation or errors in the hardware/software) or legal reasons.

Liability Blurb is only liable for damages caused by Blurb or one of its auxiliaries through intent or gross negligence, or through a breach of essential contractual obligations. This limitation does not apply to damages arising from injury to life, limb and/or health. The aforementioned liability limitation applies in particular to damages caused by errors, delays or interruptions to the transmission of data, etc., in the event of technical equipment or service faults, incorrect content, loss or deletion of data, viruses or other such causes. The participant is obliged to compensate Blurb for any damages, claims, costs and legal fees caused by or based on the fact that the participant has uploaded a photo that does not comply with these conditions of entry, including uploading a photo that infringes the rights of third parties. Final Provisions If Blurb has grounds to suspect any entrant or third party of cheating, deception or fraudulent or unsportsmanlike conduct of any kind (including, without limitation, manipulating the Contest, choice of prize winner(s) or any entry) Blurb reserves the right (in its sole discretion) to disqualify any entrant, entry or person it reasonably believes to be responsible for, or associated with, such activity. Complaints relating to the staging of the Contest must be sent to Blurb in writing within fourteen (14) days of the complaint arising. The decision regarding the selection of prizewinners and their results is final and no appeals process or correspondence will be provided. The applicable laws of the United States and the State of California, regardless of the location from which a participant enters the Contest, exclusively govern the Contest. This excludes mandatory consumer protection law at the participant's place of residence. NEDERLANDSE VERSIE Voorwaarden voor deelname aan de wedstrijd Deze Wedstrijd wordt georganiseerd door Blurb. De Wedstrijd, die wordt aangestuurd via het online platform Iconosquare, wordt op geen enkele wijze gesponsord, ondersteund of georganiseerd door Instagram/Iconosquare. Alle vragen, opmerkingen en klachten met betrekking tot deze Wedstrijd dienen direct naar Blurb te worden gezonden en niet naar Iconosquare; dit is eveneens van toepassing op alle claims die voortkomen uit de aansturing van de Wedstrijd. Deelname vindt uitsluitend online plaats en is gratis.

Deelname Door mee te doen met deze Wedstrijd gaan deelnemers specifiek akkoord met deze inschrijfvoorwaarden en de toepassing van de Amerikaanse en Californische wetgeving. Iedereen die minimaal achttien (18) jaar is op het moment van inschrijving en die in het bezit is van een Instagram/Iconosquare account kan meedoen met de Wedstrijd. Deelname aan de Wedstrijd is niet afhankelijk van een aankoop of het gebruik van diensten. Iedere deelnemer mag slechts één (1) inzending indienen.

Voorwaarden voor inschrijving Gedurende de Looptijd van de Wedstrijd (1 september 00:01 uur t/m 16 september 2016 23:59 uur), dienen deelnemers gebruik te maken van de gratis fotodeelservice Instagram/Iconosquare of http://www.blurb.com/vacayorstaycay (om direct een foto te uploaden) om een foto te uploaden waarop te zien is hoe ze hun vakantie hebben doorgebracht (of dat nu thuis of elders was). Elke deelnemer moet zijn Instagram/Iconosquare upload taggen met zowel #VacayorStaycay als @BlurbBooks om in aanmerking te komen voor de Wedstrijd. Inzendingen zonder de hashtag en @BlurbBooks dingen niet mee. De volgende Contentregels zijn van toepassing voor wat betreft de inhoud van de foto. Ingezonden foto's of kunstwerken mogen:

Niet worden genomen zonder toestemming van het onderwerp (en het onderwerp van de afbeelding mag niet jonger zijn dan 18 jaar zonder toestemming van diens wettelijk bevoegde voogd); 5. Niet de intentie hebben om een andere persoon te intimideren, boos te maken, in verlegenheid te brengen, ongerust te maken of te irriteren; 6. Geen gevaarlijk of riskant gedrag tonen of daartoe aanmoedigen; 7. Geen discriminatie op basis van ras, sekse, religie, nationaliteit, handicap, seksuele geaardheid of leeftijd tonen of daartoe aanmoedigen; 8. Geen illegale of onzedelijke activiteit, geweld, rassenhaat, dierenmishandeling of enig ander asociaal of onwettelijk gedrag van welke aard dan ook tonen of daartoe aanmoedigen; en 9. Niet de indruk wekken dat het uitgaat van, of wordt gesteund door Blurb.

Indien foto's inbreuk maken op de Contentregels of op het toepasselijk recht, behoudt Blurb zich het recht voor om deze te ont-taggen, offline te halen, te verwijderen of te wissen (waar mogelijk). In elk geval zullen dergelijke foto's (en de deelnemer die ze heeft gepost) worden gediskwalificeerd van de Wedstrijd. Door de foto te uploaden, staan deelnemers ervoor garant dat en zorgen dat zij de wettelijke en nuttige eigenaar zijn van de intellectuele eigendomsrechten van hun foto en dat het hun originele werk is en geen inbreuk maakt op de rechten van enige derde. De deelnemers zien hierbij af van en komen overeen om geen morele rechten in en met betrekking tot de foto uit te oefenen. Alle personen die op de foto staan dienen ermee akkoord te gaan dat zij hierop zichtbaar zijn en dat deze wordt geüpload via Instagram/Iconosquare, of direct wordt geüpload, en zij dienen eveneens af te zien van en overeen te komen dat zij geen toepasselijke schending van morele of vergelijkbare rechten uit zullen oefenen en gaan ermee akkoord dat de foto wordt ingediend

voor de Wedstrijd. De inzenders staan ervoor garant dat de toepasselijke toestemmingen zijn verkregen. Deze verklaringen zijn eveneens van toepassing op de gebruikte platforms van Instagram/Iconosquare. Door de foto te uploaden, geven deelnemers Blurb en de bedrijven die verbonden zijn met Blurb een onherroepbaar, overdraagbaar, wereldwijd, rechtenvrij gebruik voor twee (2) jaar voor iedere gebruiksmethode, in het bijzonder het gebruik, de distributie, reproductie, vertaling en aanpassing van de foto en eventuele begeleidende tekst voor de commerciële doeleinden van Blurb. De deelnemer accepteert eveneens dat alle foto's die zijn geüpload via Instagram, Iconosquare, Twitter en op de deelnemende Facebook pagina's te zien zullen zijn in een fotogalerij op http://www.blurb.com/vacayorstaycay op de website van Blurb en op die van Iconosquare. Deze pagina's worden in realtime bijgewerkt. Deze verklaringen zijn eveneens van toepassing op Instagram/Iconosquare.

Prijzen Aan het einde van de Wedstrijd zullen er drie (3) winnaars worden geselecteerd door een panel. Deze winnaars zullen zowel worden bekend gemaakt via de Instagram/Iconosquare Wedstrijdpagina als via de Facebook pagina en het Twitter account van Blurb. Inzendingen zullen worden beoordeeld op de volgende criteria: (1) Compositie, (2) Belichting en (3) Verhaallijn.

Hoofdprijs: De winnaar van de 1e plaats ontvangt een cadeaubon ter waarde van EUR 1000 te gebruiken op een vakantiebestemming naar keuze. Daarnaast ontvangt de winnaar van de 1e plaats een prijs ter waarde van EUR 500 te gebruiken op Blurb.com. 2e plaats: De winnaar van de 2e plaats ontvangt een cadeaubon ter waarde van EUR 500 te gebruiken op een verblijf bij huis naar keuze. Daarnaast ontvangt de winnaar van de 2e plaats een prijs ter waarde van EUR 300 te gebruiken op Blurb.com. 3e plaats: De winnaar van de 3e plaats ontvangt een cadeaubon ter waarde van EUR 200 en een prijs ter waarde van EUR 100 te gebruiken op Blurb.com. Drie (3) winnaars zullen worden geselecteerd binnen drie (3) weken na afloop van de Wedstrijd.

Uitsluiting van de Wedstrijd

Medewerkers van Blurb en van bedrijven die verbonden zijn met Blurb, evenals hun familieleden en relaties zijn uitgesloten van deelname aan de Wedstrijd. Mensen die (i) onjuiste persoonlijke gegevens opgeven, (ii) illegale content aanleveren, of (iii) elektronische apparatuur die is gemaakt voor het doel van de Wedstrijd manipuleren of anderszins verkeerd gebruiken, zijn uitgesloten van deelname aan de Wedstrijd.

Voortijdige beëindiging van de Wedstrijd Blurb behoudt zich het recht voor om de Wedstrijd op elk moment tijdens de looptijd van de Wedstrijd te beëindigen, zonder voorafgaande waarschuwing en zonder opgaaf van reden. Dit is in het bijzonder van toepassing in het geval dit nodig is in één of meer landen voor organisatorische of technische redenen (bijv. virussen in het computersysteem, manipulatie van of fouten in de hardware/software) of om juridische redenen.

Aansprakelijkheid Blurb is slechts aansprakelijk voor schade die met opzet of door grove nalatigheid, of door een inbreuk op wezenlijke contractuele verplichtingen is veroorzaakt door Blurb of een van zijn medewerkers. Deze beperking is niet van toepassing op schade die voortkomt uit persoonlijk letsel. De eerdergenoemde aansprakelijkheidsbeperking is in het bijzonder van toepassing op schade veroorzaakt door fouten, vertragingen of onderbrekingen in de verzending van data, etc., in het geval van falende technische apparatuur of diensten, onjuiste content, verlies of verwijdering van data, virussen of andere vergelijkbare oorzaken.

De deelnemer is verplicht om Blurb te compenseren voor schade, claims, kosten en juridische kosten veroorzaakt door of op basis van het feit dat de deelnemer een foto heeft geüpload die niet in overeenstemming is met deze inschrijfvoorwaarden, inclusief het uploaden van een foto die inbreuk maakt op de rechten van derden.

Slotbepalingen Indien Blurb met gegronde reden een inzender of derde verdenkt van bedrog, misleiding of frauduleus of onsportief gedrag van welke aard dan ook (inclusief, zonder beperking, manipulatie van de Wedstrijd, keuze van de prijswinnaar(s) of welke inzending dan ook) behoudt Blurb zich het recht voor om elke inzender, inzending of persoon die wordt verdacht

verantwoordelijk te zijn voor of in verband wordt gebracht met die activiteit (naar eigen goeddunken) te diskwalificeren.

Klachten met betrekking tot de inrichting van de Wedstrijd dienen binnen veertien (14) dagen vanaf het moment waarop de klacht ontstaat, schriftelijk te worden gezonden aan Blurb. De beslissing met betrekking tot de selectie van de prijswinnaars en hun resultaten is definitief en kan niet worden aangevochten en er wordt niet over gecorrespondeerd.

Ongeacht de locatie van waaruit een deelnemer deelneemt aan de Wedstrijd, zijn uitsluitend de toepasselijke wet- en regelgeving van de Verenigde Staten en de State of California van toepassing op de Wedstrijd. Ook verplichte consumentenbeschermingswetgeving in de woonplaats van een deelnemer is hiervan uitgesloten.

Indien individuele voorzieningen ondoelmatig of niet-afdwingbaar zijn of worden, dan blijft de validiteit van de resterende voorzieningen onaangepast van toepassing.

Le concours, qui est géré via la plateforme en ligne Iconosquare, n’est en aucun cas sponsorisé, appuyé ou organisé par Instagram/Iconosquare. Tout commentaire, question et réclamation ayant trait à ce concours devra être envoyé directement à Blurb et non à Iconosquare. Il en va de même pour toute réclamation liée à l’administration du concours. La participation aura exclusivement lieu en ligne et est gratuite. Participation En prenant part à ce concours, les participants acceptent expressément les conditions d'admission et l'application de la législation des États-Unis et de Californie. Quiconque ayant au minimum dix-huit (18) ans au moment de l'admission, et ayant un compte Instagram/Iconosquare peut participer au concours. La participation n'est pas soumise à un achat ou à l'usage de services. Chaque participant ne devra se présenter qu'une (1) seule fois.

Conditions d'admission Durant la période du concours (du 1er septembre, 12h01 heure du Pacifique, au 16 septembre 2016, 23h59 heure du Pacifique), les participants devront utiliser le service de partage de photos gratuit, Instagram/Iconosquare, ou directement télécharger leur photo sur http://www.blurb.com/vacayorstaycay, qui montre comment ils ont passé leurs vacances à l’extérieur ou sont restés chez eux pour leurs vacances. Chaque participant devra taguer sa photo Instagram/Iconosquare avec le hashtag #VacayOrStaycay et @BlurbBooks pour pouvoir participer au concours.

Les soumissions non accompagnées du hashtag et de @BlurbBooks ne seront pas admissibles. Les normes suivantes régissent le contenu des photos. Toute photo ou œuvre ne doit en aucun cas :

1. présenter un contenu diffamatoire contre quiconque ;

2. présenter un contenu obscène, offensif, haineux ou provocateur (ou de caractère explicitement sexuel) ; 3. enfreindre tout droit d'auteur, droits sur une base de données ou marque appartenant à quiconque (comme une photographie protégée par un droit d'auteur, une peinture ou une autre photographie prise sans le consentement du propriétaire) afin d’induire quelqu'un en erreur ; 4. être prise sans le consentement du sujet (ou mettre en avant toute personne mineure sans le consentement de leur tuteur légal) 5. être de nature à harceler, perturber, gêner, inquiéter ou déranger toute personne ; 6. montrer ou encourager un comportement risqué ou dangereux ; 7. montrer ou encourager la discrimination fondée sur la race, le sexe, la religion, la nationalité, le handicap, l’orientation sexuelle ou l’âge ; 8. montrer ou encourager toute activité violente illégale ou immorale, haine raciale, cruauté envers les animaux ou tout autre comportement anti-social ou illégal de toute nature ; 9. donner l'impression qu'elle provient ou est cautionnée par Blurb.

Si une photo enfreint les normes de contenu ou toute loi applicable, Blurb se réserve le droit de retirer le tag, d’enlever ou d’effacer (si possible) toute image. En tout état de cause, de telles photos (et le participant les ayant publiées) seront disqualifiés du concours.

En téléchargeant la photo, les participants garantissent et promettent qu’ils sont les propriétaires juridiques et bénéficiaires de tous les droits de propriété intellectuelle de la photographie et qu’il s’agit de leur propre travail original qui n’enfreint pas les droits de tiers. Les participants acceptent de ne pas formuler de revendication quant au droit moral en lien avec la photographie et y renoncent.

Toutes les personnes apparaissant sur la photographie doivent consentir à y figurer et à ce que celle-ci soit téléchargée directement ou via Instagram/Iconosquare, et elles doivent aussi

accepter de ne pas revendiquer toute invasion qui peut en découler sur leurs droits moraux ou tout autre droit du fait du téléchargement de la photographie aux fins du concours et renoncent à cette revendication. Les participants garantissent que les accords appropriés ont été obtenus. Ces observations s’appliquent également aux plateformes Instagram/Iconosquare utilisées.

En téléchargeant la photographie, les participants autorisent Blurb et les entreprises associées à un droit irrévocable, transférable, gratuit et s'appliquant dans le monde entier pendant deux (2) ans et couvrant toutes les méthodes d'utilisation, en particulier l'usage, la distribution, la reproduction, la traduction et la modification de la photographie et de tout texte l'accompagnant à des fins commerciales par Blurb.

Le participant accepte également que toutes les photographies téléchargées via Instagram/Iconosquare, Twitter et sur les pages Facebook participant apparaîtront dans une galerie de photographies sur le site Web de Blurb http://www.blurb.com/vacayorstaycay et d'Iconosquare. Ces pages sont actualisées en temps réel. Cet avertissement s'applique également à Instagram/Iconosquare.

Prix À la fin du concours, trois (3) gagnants seront sélectionnés par un jury. Exclusion du concours Les employés de Blurb et des entreprises associées à Blurb ainsi que les membres de leur famille et proches sont exclus du concours. Seront exclues, les personnes qui 1) fournissent des informations personnelles incorrectes, 2) fournissent des contenus illégaux ou 3) manipulent ou font de manière générale un mauvais usage des appareils électroniques créés aux fins du concours. Interruption anticipée du concours Blurb se réserve le droit de mettre fin au concours à tout moment pendant la période du concours, et ce, sans préavis et sans exposer les motifs. Clauses finales Si Blurb a des raisons de soupçonner qu'un participant ou un tiers triche, trompe ou adopte une conduite frauduleuse ou déloyale de toute nature (notamment et sans s'y limiter, toute personne manipulant le concours, le choix d’un ou des gagnants ou de toute participation), Blurb

se réserve le droit (à sa seule discrétion) de disqualifier tout participant, participation ou personne dont elle pense raisonnablement responsable de, ou associée, à une telle activité. Les réclamations liées à l'organisation du concours doivent être envoyées à Blurb dans les quatorze (14) jours suivant la formulation de la réclamation. Le foto che non presentano sia l'hashtag #VacayOrStaycay che @BlurbBooks non saranno ammesse al concorso. Ai soggetti delle foto verranno applicati i seguenti Standard di Contenuto. Le foto e le opere grafiche caricate non devono:

1. contenere materiale diffamatorio per le persone; 2. contenere materiale osceno, offensivo, esecrabile od oltraggioso (o di natura sessualmente esplicita); 3. violare copyright, diritti di database o di marchi commerciali di altre persone (ad esempio foto di opere coperte da copyright, come dipinti o fotografie, scattate senza il consenso del proprietario) che siano potenzialmente ingannevoli; 4. ritrarre soggetti che non abbiano dato il loro esplicito consenso (o ritrarre un soggetto minorenne senza l’esplicito consenso dei genitori o dei tutori); 5. essere potenzialmente ingiuriose, imbarazzanti, allarmanti, irritanti per altre persone; 6. mostrare o promuovere comportamenti rischiosi o pericolosi; 7. mostrare o promuovere discriminazioni in base a etnia, sesso, religione, nazionalità, disabilità, orientamento sessuale o età; 8. mostrare o promuovere attività illegali o immorali, violenza, odio razziale, crudeltà verso gli animali o altri comportamenti antisociali o illeciti; oppure 9. dare l’impressione di provenire, o essere avallate, da Blurb.

Qualora una delle foto caricate dovesse venire meno ai sopraindicati Standard di Contenuto o infrangere una qualsiasi delle leggi in vigore, Blurb si riserva il diritto di cancellare la tag, rimuovere, eliminare o cancellare (ove possibile) tale immagine. In ogni caso, tale foto (e il partecipante che l’ha pubblicata) verrà squalificata dal Concorso. Caricando la propria foto, i concorrenti si impegnano e garantiscono di essere i detentori legali e formali di tutti i diritti di proprietà intellettuale in essa manifesti e che la suddetta foto sia una propria creazione originale che non viola diritti di terzi. I concorrenti rinunciano e accettano di non volere affermare nessun diritto morale sulla, e in relazione alla, foto caricata. Tutte le persone ritratte nella foto devono aver dato il proprio consenso tanto a esservi raffigurati, tanto a che la stessa venga caricata mediante Instagram/Iconosquare o caricamento diretto. Devono aver anche rinunciato e accettato di non volere affermare sulla stessa alcun diritto morale o di altro tipo, e aver acconsentito alla partecipazione al Concorso della suddetta foto caricata. Caricando la propria foto, pertanto, i concorrenti garantiscono di aver ottenuto tutti i necessari consensi. Quanto indicato vale anche in relazione alle piattaforme Instagram/Iconosquare utilizzate.

Caricando la propria foto, i concorrenti conferiscono a Blurb e alle aziende associate a Blurb il diritto irrevocabile, trasferibile, universale, incondizionato di utilizzo per due (2) anni a coprire tutte le modalità d’uso della stessa e, in particolare, l’utilizzo, la distribuzione, la riproduzione, il trasferimento e la modifica della foto e di eventuale testo di accompagnamento a scopo commerciale di Blurb. Inoltre i concorrenti accettano che tutte le foto caricate mediante Instagram/Iconosquare, Twitter e sulle pagine Facebook partecipanti compaiano nella galleria di foto all'indirizzo http://www.blurb.com/vacayorstaycay sul sito web di Blurb e sul sito web di Iconosquare. Premi Al termine del Concorso una giuria selezionerà tre (3) vincitori che verranno annunciati sulla pagina Instagram/Iconosquare del Concorso, oltre che sulla pagina Facebook di Blurb e sull’account Twitter di Blurb. Le foto in concorso saranno valutate sulla base dei seguenti criteri: (1) Composizione, (2) Luce e (3) Storia. Primo premio: il concorrente della prima foto in classifica riceverà una carta prepagata del valore di 1.000,00 € spendibile per una vacanza a propria scelta. Inoltre riceverà un buono regalo da 500,00 € spendibile su Blurb.com. Esclusione dal Concorso

Si intendono esclusi dal Concorso tanto i dipendenti di Blurb e delle aziende associate a Blurb quanto i loro familiari e parenti. Las fotos o el material gráfico enviados no deben:

1. Contener ningún material que difame a otra persona ; 2. Contener ningún material que promocione el odio o que sea obsceno, ofensivo, provocador o de naturaleza sexualmente explícita;

3. Infringir ningún copyright, derecho de bases de datos o marca comercial de otra persona (por ejemplo, una foto de una obra con copyright, como un cuadro u otra fotografía, hecha sin el permiso del propietario) ni engañar a ninguna persona 4. Tomarse sin el consentimiento del sujeto (o mostrar a un sujeto menor de edad sin el consentimiento de su tutor legal); 5. Acosar, molestar, avergonzar, alarmar o enfadar a cualquier persona; 6. Mostrar o fomentar un comportamiento arriesgado o peligroso; 7. Mostrar o fomentar la discriminación por motivos de raza, sexo, religión, nacionalidad, discapacidad, orientación sexual o edad; 8. Mostrar o fomentar cualquier actividad ilegal o inmoral, violencia, ocio racial, crueldad con los animales o cualquier otro comportamiento antisocial o ilícito de cualquier naturaleza; o 9. Si alguna de las fotos incumple las Bases del Concurso o cualquier ley vigente, Blurb se reserva el derecho a desetiquetar, retirar o eliminar (cuando sea posible) cualquiera de esas imágenes. En cualquier caso, dichas fotos (y el participante que las haya enviado) quedarán descalificadas del Concurso. Al subir la foto, los participantes garantizan que son los propietarios legales y beneficiarios de los derechos de propiedad intelectual de su foto, y que esa foto es su obra original y no infringe los derechos de ningún tercero. Por el presente, los participantes afirman que no reivindicarán ningún derecho moral en relación con la foto. Todas las personas que aparezcan en la foto deben dar su consentimiento para aparecer en ella y para que la foto se suba a Instagram/Iconosquare, y deben renunciar a cualquier derecho moral o similar y dar su consentimiento para que la foto participe en el Concurso. September 2016, 23:59 Uhr Pazifische Standardzeit) müssen die Teilnehmer – entweder über den kostenlosen Fotosharing-Dienst Instagram/Iconosquare oder direkt auf http://www.blurb.com/vacayorstaycay – ein Foto hochladen, das darstellt, wie sie ihren Urlaub verbracht haben (egal ob in fremden Ländern oder auf Balkonien). Jeder Teilnehmer muss seinen Instagram/Iconosquare-Upload mit #VacayOrStaycay und @BlurbBooks taggen, um zum Wettbewerb zugelassen zu werden. Beiträge ohne Hashtag und @BlurbBooks–Vermerk sind von der Teilnahme ausgeschlossen. Für den Inhalt der Fotos gelten die folgenden inhaltlichen Richtlinien. Die eingereichten Fotos bzw. Werke dürfen:

1. andere Personen in keiner Weise diffamieren; 2. keine obszönen, beleidigenden, hasserfüllten oder hetzerischen bzw. explizit sexuellen Inhalte aufweisen; 3. keine Urheber-, Datenbank- oder Markenrechte anderer Personen verletzen (z. B. ein Foto eines urheberrechtlich geschützten Werkes, wie etwa ein Gemälde oder ein fremdes Foto, das ohne die Erlaubnis des Eigentümers aufgenommen wurde) – oder andere Personen in die Irre führen; 4. nicht ohne die Einwilligung der abgebildeten Person aufgenommen worden sein oder Personen unter 18 Jahren ohne Einwilligung eines Erziehungsberechtigten abbilden; 5. nicht Gefahr laufen, andere Personen zu belästigen, in Verlegenheit zu bringen, zu beunruhigen oder verärgern; 6. kein riskantes oder gefährliches Verhalten darstellen oder dazu anregen; 7. nicht Diskriminierung aufgrund von Ethnie, Hautfarbe, Geschlecht, Religion, Nationalität, Behinderung, sexueller Orientierung oder Alter darstellen oder dazu anregen; 8. keine rechtswidrigen oder unmoralischen Tätigkeiten, Gewalt, ethnisch motivierten Hass, Tierquälerei oder jegliches andere unsoziale oder rechtswidrige Verhalten darstellen oder dazu anregen; oder 9. den Eindruck vermitteln, dies würde von Blurb ausgehen bzw. von Blurb gefördert. Sollte ein Foto gegen die inhaltlichen Richtlinien oder geltendes Recht verstoßen, behält sich Blurb das Recht vor, die Tags davon zu entfernen, es von der Seite zu nehmen, zu entfernen oder zu löschen (falls möglich). Solche Fotos (und der Teilnehmer, der es gepostet hat) werden in jedem Fall vom Wettbewerb ausgeschlossen. Durch das Hochladen des Fotos garantieren und versichern die Teilnehmer, dass sie die rechtlichen und nutznießenden Inhaber aller geistigen Eigentumsrechte an ihrem Foto sind und dass es sich dabei um ihr persönliches Originalwerk handelt, durch das keine Rechte Dritter verletzt werden. Die Teilnehmer versichern hiermit, keinerlei Urheberpersönlichkeitsrechte an dem Foto bzw. solche, die damit in Zusammenhang stehen, geltend zu machen. Alle auf einem Foto abgebildeten Personen müssen mit ihrer Abbildung sowie mit dem Hochladen desselben via Instagram/Iconosquare oder durch direkten Upload einverstanden sein. Sie müssen außerdem mit dem Verzicht auf eventuelle Persönlichkeitsrechte oder ähnliche Rechte sowie mit dem Einreichen des Fotos für diesen Wettbewerb einverstanden sein. Die

Teilnehmer versichern dabei, dass die nötigen Einverständnisse eingeholt wurden. Diese Erklärungen gelten auch für die verwendeten Instagram/Iconosquare-Plattformen. Durch das Hochladen des Fotos erteilen die Teilnehmer Blurb und den mit Blurb verbundenen Unternehmen ein unwiderrufliches, übertragbares, weltweites, kostenloses Nutzungsrecht für einen Zeitraum von zwei (2) Jahren. Dies umfasst alle Nutzungsformen, insbesondere die Verwendung, Verbreitung, Reproduktion, Übersetzung und Modifizierung des Fotos und aller Begleittexte für kommerzielle Zwecke durch Blurb. Preise Am Ende des Wettbewerbs wird eine Jury drei (3) Gewinner auswählen, die über die Instagram/Iconosquare-Wettbewerbsseite, die Blurb-Facebookseite und das Twitter-Profil von Blurb bekannt gegeben werden. Platz: Der Einsender des zweitplatzierten Fotos erhält eine Geschenkkarte im Wert von 500 €, die er frei nutzen kann – z. B. für einen Heimurlaub seiner Wahl. Zusätzlich erhält er eine bei Blurb.com einlösbare Geschenkkarte im Wert von 300 €. 3. Platz: Der Einsender des drittplatzierten Fotos erhält eine frei einlösbare Geschenkkarte im Wert von 200 € sowie eine bei Blurb.com einlösbare Geschenkkarte im Wert von 100 €. Die Auswahl der drei (3) Gewinner wird innerhalb von drei (3) Wochen nach Beendigung des Wettbewerbs erfolgen.

Teilnahmeausschluss

Mitarbeiter von Blurb und von mit Blurb verbundenen Unternehmen sowie deren Familienangehörige und Verwandte sind von der Teilnahme an diesem Wettbewerb ausgeschlossen. Personen, die (i) falsche persönliche Informationen angeben, (ii) rechtswidrige Inhalte einreichen oder (iii) elektronische Geräte, die für den Zweck des Wettbewerbs geschaffen wurden, manipulieren oder anderweitig missbrauchen, werden ausgeschlossen.

Vorzeitige Beendigung des Wettbewerbs Blurb kann den Wettbewerb jederzeit während seines Verlaufs ohne Vorankündigung oder Angabe von Gründen beenden. Dies gilt insbesondere in Fällen, in denen dies in einem oder mehreren Ländern aus organisatorischen, technischen (z. B. Computerviren, Manipulation oder Fehler von Hardware- oder Software) oder rechtlichen Gründen notwendig ist.

Haftung Blurb haftet ausschließlich für von Blurb oder einem seiner Helfer vorsätzlich oder durch grobe Fahrlässigkeit bzw. durch die Verletzung grundlegender Vertragspflichten verursachte Schäden. Diese Beschränkung gilt nicht für Schäden durch die Verletzung von Leben, Körper oder Gesundheit. Die vorgenannte Haftungsbeschränkung gilt insbesondere für Schäden, die durch Fehler, Verzögerungen oder Unterbrechungen bei der Datenübertragung etc. verursacht wurden, im Falle von Geräte- oder Service-Ausfällen, falschen Inhalten, Verlust oder Löschung von Daten, Viren oder ähnlichen Ursachen. Der Teilnehmer ist verpflichtet, Blurb für alle Schäden, Ansprüche, Kosten oder Anwaltshonorare zu entschädigen, die durch oder basierend auf der Tatsache verursacht werden, dass er ein Foto hochgeladen hat, das den vorliegenden Teilnahmebedingungen nicht entspricht, einschließlich dem Hochladen eines Bildes, das die Rechte Dritter verletzt.

Schlussbestimmungen Bei dem Verdacht auf Betrug, Täuschung oder betrügerisches bzw. unsportliches Verhalten jeglicher Art seitens eines Teilnehmers oder eines Dritten (einschließlich der Manipulierung des Wettbewerbs, der Siegerauswahl oder eines Beitrags) behält sich Blurb das Recht vor, nach seinem alleinigen Ermessen Teilnehmer, Einsendungen oder Personen zu disqualifizieren, von denen begründet anzunehmen ist, dass sie für diese Aktivitäten verantwortlich sind bzw. damit in Verbindung stehen.

Beschwerden bezüglich der Durchführung des Wettbewerbs sind innerhalb von vierzehn (14) Tagen nach Auftreten des Beschwerdegrunds schriftlich an Blurb zu senden. Die Entscheidung bezüglich der Gewinnerauswahl und ihrer Ergebnisse ist endgültig und es wird kein Widerspruchsverfahren oder dergleichen geben. Der Wettbewerb unterliegt ausschließlich dem geltendem Recht der Vereinigten Staaten und des Staates Kalifornien, unabhängig vom Ort, von dem aus der Teilnehmer seinen Beitrag einreicht. Davon ausgenommen sind am Wohnort des Teilnehmers vorgeschriebene geltende Verbraucherschutzbestimmungen. Sollten einzelne Bestimmungen unwirksam oder nicht vollstreckbar sein bzw. werden, hat dies keine Auswirkungen auf die Gültigkeit der übrigen Bestimmungen.
