The Pastor’s Keyboard—Msgr. Richard Huneger In two recent Pastor's Keyboards, I reported on the May 2 federal rollback of prior administration regulations deciding not to enforce conscience protections, and of the US Bishops' call to pass the Conscience Protection Act. I also noted that certain prominent folk are asking whether it is still possible to justify having children any more (i.e., does the human race have a responsibility to go extinct, rather than causing a global warming catastrophe that will make us extinct). I noted the concerns expressed by Paul Ehrlich and Garrett Hardin (dire predictions, and suggestions that the human race be reduced to about 50 million people). Ever since the 1980's Supreme Court justice nominations have been in the midst of a firestorm over ideas about abortion, and what the nominees would do to Roe v Wade, given the chance to participate in a related case. Mother Teresa of Calcutta (revered or reviled, depending on your perspective) used to say that abortion was "the greatest violence" and "the greatest poverty" and accepting it set the stage for accepting nuclear war, and proved a society devoid of any moral value. Others said it differently, like, "If life is the first right, how can any others be safe if the first right is not acknowledged?" The late Justice Anthony Scalia was a strict constructionist, and he felt the Constitution didn't specifically say anything one way or another about abortion, and so it was a state-level question, not a federal question. But a recent article in the Harvard Law Journal argues that the unborn child is indeed a "constitutional person." The author notes that the 14th Amendment, ensuring that Blacks would be protected as "persons" after the Civil War, gives constitutional warrant for the protection of all "persons," even the unborn. It restricts the rights of states in an area of "fundamental values," which must be "uniform" throughout the country. Thus, the states of the Confederacy had to sign on to the 14th Amendment in order to be restored to the Union. The 14th Amendment actually, finally, "imposed" the Bill of Rights on the States (instead of rights just having to be respected by the federal government): thus, when the First Amendment says the government shall make no law respecting the "establishment of religion," it meant that the federal government could not by law make a particular religion into the national religion (or make belonging to such a religion a requirement for holding office, or other benefits); however, states were still free to have at the state level a state religion. This was "establishmentarianism," and those who wanted this state right to be taken away were called "dis-establishmentarians," and those who objected to these folk were called "anti-dis-establishmentarians." In 1838, Massachusetts was the last state to abolish its state-level official religion. It is now considered unconstitutional for a state, such as Oregon, to establish an official state-level religion. Due process protection is now broader, and consistent with federal due process requirements, even at the state level. But, to return to the article in the HLR. The author argues that the long tradition of law in Great Britain and in our country held that "where life can be shown to exist, there is personhood." Centuries ago, this meant, once "quickening" was noticed, for sure, abortion could not be done, and was equivalent to homicide. At the time of the Civil War, when arguments were being made in Congress for the Fourteenth Amendment, its proponents clearly envisaged a constitutional protection for "all" persons, high and low, greatest to least, and so on. And at the time many of the states had laws restricting abortion tougher than the common law tradition ("quickening"), and even prohibiting termination of life after "fertilization" (newly discovered, and appearing obviously to confirm "life" and "personhood" even before "quickening"), with almost all of them organizing their statutes under the category of "crimes against the person." Thus, it is ingenuous to argue that "due process" for "all persons" merely applied to former slaves living at the time of the Civil War. The amendment was meant to enshrine an encompassing principle to interpret more fundamentally and more forcefully and more consistently, beyond doubt, what was in the spirit of the original document. Thus, the HLR article argues that Scalia was not sufficiently attentive to the Constitution's intent regarding personhood, when he felt that it did not have to do with abortion, because the word was not mentioned. The Fourteenth Amendment (Section 1) is wide-ranging, and is central to many other debates: same-sex marriage, citizenship by mere birth on our soil, etc.
