"Por la cual se modifica, aclara y se unifica lo establecido en las Resoluciones No 13039 y 13883 de 2017, con relación a los turnos de prestación del servicio notarial para los días sábados del año 2018, en los círculos del país que cuentan con más de una Notaría"
EL SUPERINTENDENTE DE NOTARIADO Y REGISTRO En ejercicio de las facultades legales, en especial las otorgadas por el Decreto 2723 de 2014,
CONSIDERANDO QUE: La Constitución Política en su artículo 365, consagra que: "Los servicios públicos son inherentes a la finalidad social del Estado. Es deber del Estado asegurar su prestación eficiente a todos los habitantes del territorio nacional "Los servicios públicos estarán sometidos al régimen jurídico que fije la ley podrán ser prestados por el Estado, directa o indirectamente, por comunidades organizadas, o por particulares. En todo caso, el estado mantendrá la regulación, el control y vigilancia de dichos servicios (...)" El artículo 158 del Decreto Ley 960 de 1970, dispone que "los Notarios tendrán las horas de despacho público que sean necesarias para el buen servicio y que señale la vigilancia notarial".
Que tendiendo la norma antes citada, la Superintendencia de Notariado y Registro ha dispuesto que el servicio notarial se preste los días sábados por turnos en los círculos notariales del país que exista más de una Notaría. Que se hace necesario unificar los actos administrativos mediante los cuales se ha reglamentado el sistema de turnos para la prestación del servicio público los días sábados, en los círculos notariales del país en donde existe más de una Notaría. Que mediante Resolución 13039 del 29 de Noviembre de 2017, se establecieron los turnos de prestación del servicio notarial para los días sábados del año 2018, en los círculos del país que cuentan con más de una Notaría. Que mediante Resolución 13883 del 22 de Diciembre de 2017, se adicionó a la Resolución 13039 del 29 de Noviembre de 2017, en el sentido de incorporar unos folios que no fueron tenidos en cuenta en el proceso de divulgación, con relación a la prestación del servicio notarial para los días sábados del año 2018, en los círculos del país que cuentan con más de una Notaría.

DE
Que para establecer los turnos de la prestación del servicio notarial para los días sábados se tiene en cuenta la población, las necesidades de la comunidad y el número de notarios que comprende el respectivo círculo y conforme a ello, se propone implementar de manera racional, los turnos para prestación del servicio notarial los días sábados, los cuales deben cumplirse por lo notarios del país, sin perjuicio del que prestan algunas notarías en cumplimiento a la jornada habitual de atención al público, previamente solicitada por cada notario y autorizada por la Dirección de Administración Notarial mediante acto administrativo para cumplir con el horario laboral legalmente establecido. Que en pro de una distribución equitativa de los turnos de los días sábados se hace necesaria la expedición de un acto administrativo integral que cobije plenamente los círculos del país que cuentan con más de una Notaría. En mérito de lo expuesto, el Superintendente de Notariado y Registro,
RESUELVE: ARTÍCULO PRIMERO. Implementación. Modificar, aclarar y unificar los actos administrativos mediante los cuales se reglamenta el sistema de turnos para la prestación del servicio público los días sábados, en los círculos notariales del país en donde existe más de una notaría, a partir del primer sábado del mes de mayo del año 2018 y sucesivos, de la siguiente forma: DEPARTAMENTO DE ANTIOQUIA. ARTÍCULO SEGUNDO. Suspensión del servicio. Cuando la Superintendencia de Notariado y Registro autorice la suspensión en la prestación del servicio para una o varias de las notarías que se encuentren de turno el correspondiente sábado, éstas no están obligadas a reponerlo. Consecuentemente, la atención al público para el siguiente sábado continuará y se entenderá por las notarías de turno asignadas conforme al calendario y distribución que se establece mediante este acto administrativo.

ARTÍCULO TERCERO. Modificación del horario autorizado para la prestación del servicio.- La asignación de turnos aquí prevista para la prestación del servicio notarial, es independiente del horario de servicio habitual de aquellas Notarías que se encuentran autorizadas mediante acto administrativo para laborar normalmente todos los sábados. De acogerse al sistema de turnos, el titular del respectivo despacho notarial deberá solicitar a la Dirección de Gestión Notarial, se emita nueva resolución que le autorice el horario de atención al público con sujeción al turno que le corresponda el día sábado, en el círculo de que se trate. ARTÍCULO CUARTO. Publicación. La presente resolución se fijará en lugar visible al público de cada uno de los mencionados despachos notariales para que sea conocida por los usuarios y la ciudadanía en general y se publicará en la página web institucional. ARTÍCULO QUINTO. Vigencia. Este acto administrativo rige a partir de la fecha de su expedición, aclarando y unificando el contenido de la Resolución No 13039 del 29 de noviembre de 2017, así como también lo contenido en la Resolución 13883 del 22 de diciembre de 2017 y deja sin efectos las demás disposiciones que le sean contrarias.
